Spotto Driving School reserves the right to update and change the Terms of Service without notice.

Account Terms

This page contains the most current version of the Terms of Service.

• You agree that Spotto Driving School can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing.
• You are responsible for maintaining the security of your account and password. Spotto Driving School cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
• By purchasing from Spotto Driving School, you agree not to initiate any credit card chargeback, or dispute any payment made for services, products, digital goods, Prepaid or gift cards purchased, except in cases of proven fraud or unauthorized transactions. All disputes must be resolved directly with Spotto Driving School.
• You must not post or submit false information to the Service.
• You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
• You are responsible for all activity that occurs from your account.
• Accounts registered by "bots" or other automated methods are not permitted and will be removed.
• Spotto Driving School has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other Spotto Driving School service, for any reason.
• Violation of any of the terms or general conditions may result in the termination of your Account.
• In the event that you breach these Terms of Service, or act in a way that puts the Service or any individual at risk, Spotto Driving School has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Spotto Driving School service. Such termination of the Service will result in the deactivation of your Account.

Cancellation Rates

• Less than 24 hours notice before the booking will forfeit the full booking fee.

A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at Spotto Driving School.

Cancellation and Refund Policy

1. Objectives and Background
   
   Spotto Driving School Gold Coast Pty Ltd is committed to providing the best service in a
   timely manner. We aim to accommodate your needs.
   
   Unfortunately, when a client cancels without giving adequate notice, it prevents another
   client from being served. This cancellation policy is used as a way of respecting the time
   commitment of all involved. It explains the process for requesting a cancellation and the
   fees applicable. This policy is used in fairness to both our business and the clients who
   would otherwise have wanted an appointment.
   
   We are implementing a straightforward cancellation policy to be upfront about all the costs
   you may face when engaging our services.
2. Cancellation Process
   
   We understand situations can arise in which you must cancel your appointment. Due to
   limited appointment availability, we request that you cancel with adequate notice. This
   allows us to fill that appointment slot.
   
   You may cancel by contacting us by:

   We require a minimum of 24-48 hours notice for cancellation. Please inform us by
   04:30PM, 24-48 hours days prior to your scheduled appointment to notify us of any
   changes or cancellations.
   
   Cancellations less than 24-48 hours notice will incure the lesson to be forfeited.
   
   
3. Refund policy
   If no prior notice is given or the notice given is not in accordance with the cancellation process,
   you will forfeit your deposit for the missed appointment. Late arrivals can only be extended to the
   remaining time of the scheduled appointment. If you are 20 minutes late past your appointment
   we will have to reschedule or cancel the appointment, which may mean your deposit is forfeited.
   
   When You May Be Eligible for a Refund
   You may qualify for a refund under the following circumstances:
   (i) No driving instructors are available in your area.
   (ii) No instructors have availability for bookings within the next six (6) weeks.
   (iii) A duplicate payment has been made.
   (iv) You would like to exchange your booking vouchers, such as:
   Converting a test package voucher into lesson hours, or
   Swapping driving lesson vouchers for a driving test package.
   (v) Your instructor did not attend a scheduled lesson (Please note if another instructor attends in
   your instructors place a refund will not be supplied as the service has been provided).
   
   When Refunds Are Not Available
   (i) Refunds will not be issued in the following situations (among others):
   (ii) Your voucher balance is zero, or your vouchers have expired (lesson vouchers are valid for 6
   months).
   (iii) A change of mind, including but not limited to:
   -Finding a cheaper provider.
   -No longer requiring lessons (e.g., you have completed your logbook hours).
   -Deciding not to continue using our services.
   (iv) Your preferred instructor is unavailable, but alternative instructors are offered.
   (v) Errors made by you, including:
   (vi) Booking the wrong service type.
   (vii) Providing incorrect license details, address, or contact information.
   (viii) Not meeting licensing or eligibility requirements for your driving test.
   (ix) Failing to make an official test booking with the licensing authority.
   (x) Issues beyond our control, such as delays or errors by external licensing authorities.
   (xi) You cancelled your lesson late and were charged a cancellation fee by your instructor.
   (lx)Your lesson was cancelled due to instructor illness. (Rescheduling is offered in this
   circumstance as the cancellation is made for the safety of the instructor and the student involved).
   
   
4. Acceptable circumstances for waiving refund policy
   We understand that plans may change due to uncontrollable and external circumstances. Missed
   appointments can be unintentional or may stem from an emergency, etc. Therefore, subject to
   approval by Spotto Driving School Gold Coast Pty Ltd, cancellation due to such circumstances
   will not result in a forfeited deposit.
   
   
5. Questions
   Our business firmly believes that a good client and business relationship is based upon mutual

6. Dispute Resolution Process
   Any disputes regarding cancellations will be addressed within 1-5 business days. Clients must
   submit concerns in writing to info@spottodrivingschool.com.au. Our team will provide a detailed
   response outlining available resolution options and next steps.

Prepaid

• Prepaid are non-refundable and cannot be redeemed for cash.
• Unused prepaid can be transferred between clients.

Fees

• Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by Spotto Driving School for payment processing.
• All fees and transactions are in Australian Dollars.

General Conditions

• Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
• You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by Spotto Driving School.
• Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Spotto Driving School customer, employee, member, instructor, officer or external contractor will result in immediate account termination.
• You must not transmit any worms or viruses or any code of a destructive nature.
• You understand that Spotto Driving School uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
• Spotto Driving School does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
• You expressly understand and agree that Spotto Driving School shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Spotto Driving School has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.
• The failure of Spotto Driving School to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision.
• You expressly understand and agree that Spotto Driving School shall not be liable for any indirect, incidental, special, consequential loss, loss or corruption of data or exemplary damages, including but not limited to loss resulting from the use or the inability to use the website or the Service.
